What is Prop 65? Prop 65 (otherwise known as the California Safe Drinking Water and Toxic Enforcement Act of 1986) lays out requirements for both the State and for businesses. First the State must publish a list of chemicals which are known to cause cancer, birth defects or other reproductive harm. The second step is that businesses which are subject to Prop 65 are required to provide a clear and reasonable warning prior to distributing a product that may have a chemical listed in Prop 65. The current list contains more than 900 naturally-occurring and synthetic chemicals. Some of the listed chemicals such as lead, cadmium, and arsenic are naturally found in the environment and often found in common foods and nutrients even though these chemicals are not directly added.
